Please read these Terms of Service ("Terms") carefully before using the Rooktick app ("Chess Clock Timer – Rooktick", the "App") developed by Pradep Kumar Chinnasaamy ("I", "me", or "my"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Rooktick is a chess clock for iPhone and iPad. It times games for two players with a range of time controls (increment, delay, multi-stage, byo-yomi and overtime), and can also record the moves of a game, read a photographed paper scoresheet, keep a history of finished games, and export a game as PGN. Your games and settings are stored locally on your device.
The App is available to all users. No account or registration is required. If you are under the age at which you can agree to these Terms where you live, use the App only with the agreement of a parent or guardian, who must also approve any purchase.
The clock itself is free: timing a game never requires a subscription. An optional subscription, Chess Clock Pro ("Pro"), adds features a clock does not need to run: unlimited scoresheet scans (a small number are free), PGN export, your full game history (the most recent games are always free to view), time-use statistics, additional themes, and themes of your own.
Pro is offered as a weekly, monthly or yearly subscription. The price and period of each plan, and any free trial, are shown in the App before you buy. Subscriptions are billed through Apple's App Store via RevenueCat. By purchasing a subscription, you agree to Apple's payment terms. All billing inquiries should be directed to Apple.
Where a plan includes a free trial, you are charged when the trial ends unless you cancel at least 24 hours before it ends.
Subscriptions automatically renew at the then-current price unless you cancel at least 24 hours before the end of the current billing period. You can manage and cancel your subscription in your Apple Account settings. Deleting the App does not cancel a subscription.
When a subscription expires or is cancelled, Pro features become unavailable. The clock, the free features and your existing data remain. Games older than the free history limit are kept on your device, not deleted, and are shown again if you subscribe.
Refund requests are handled by Apple in accordance with their refund policies. I do not process refunds directly.
I may change what Pro includes, its plans or its prices. A price change does not apply to a subscription period you have already paid for, and Apple will tell you about a price change to a renewing subscription as its rules require.
You agree to use the App only for its intended purpose. You agree not to:
The App is designed to keep time accurately, but it runs on a general-purpose device and is not a certified or approved tournament clock. You acknowledge that:
The App can record moves, suggest likely moves, read a photographed scoresheet and recognise a spoken move. These features rely on your input and on on-device recognition, and they can be wrong. You acknowledge that:
The games, names, photos and other content you put into the App are yours and are stored on your device. You are responsible for anything you choose to share from the App, such as an exported PGN, and for having the right to photograph and store any scoresheet you scan.
Because your data is stored only on your device, you are responsible for backing it up. Deleting the App, or losing or resetting the device, can permanently remove your games. I cannot recover them.
The App relies on services provided by others, including Apple (the App Store, payments, and features of iOS), RevenueCat (subscriptions) and Google Firebase (analytics and crash reporting). Your use of those services is subject to their own terms. I am not responsible for their availability or for changes they make.
The App is licensed to you, not sold. These Terms are between you and me only, not with Apple, and I alone am responsible for the App and its content. To the extent these Terms are less restrictive than Apple's Licensed Application End User License Agreement or the usage rules in the Apple Media Services Terms and Conditions, those Apple terms apply. You further acknowledge that:
The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy of timing or of recorded moves, or non-infringement.
To the maximum extent permitted by applicable law, I shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, the result of a game, a clock that stopped or was mistimed, a move that was recorded or read incorrectly, or any damages resulting from the use or inability to use the App. My total liability for any claim arising from the use of the App shall not exceed the amount you paid for the App or subscription in the twelve (12) months preceding the claim.
Nothing in these Terms limits any right you have under consumer law that cannot be limited by agreement.
The App, including its design, code, features, and content, is owned by Pradep Kumar Chinnasaamy and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. Using the App to time games at a club, school or event is permitted.
Your privacy is important. Please review the Privacy Policy to understand how information is handled when you use the App.
I reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. I shall not be liable for any modification, suspension, or discontinuation of the App.
These Terms may be updated from time to time. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
